Irwin Fritchie Secures Favorable Trial Verdict in Federal Court Trucking Case

NEW ORLEANS, LA (August 2, 2023) – Irwin Fritchie Urquhart Moore & Daniels, LLC, has obtained a favorable verdict for a motor carrier following a jury trial involving claims for damages related to a trucking accident in the United States District Court for the Western District of Louisiana.
On Tuesday, July 11, a federal jury in Lafayette, LA, returned a verdict following a two-day trial in which the driver of the subject tractor trailer was presumed liable, with the jury ultimately finding the plaintiff 50% at fault for the claimed damages and reducing the damages award, significantly.
Led by Irwin Fritchie partner, Matthew W. Bailey, along with associate, Katherine Cook, the verdict was a significant victory for the defense. Despite continued medical treatment and claimed damages for past medical expenses and lost wages exceeding $80,000.00 – in addition to claims for future medical damages, future lost wages, and loss of earning capacity – the jury ultimately awarded only $11,541.30 in total damages to the plaintiff, which was further reduced by 50% due to the jury finding the plaintiff at fault in the accident.
